1. Definitions
In these Terms & Conditions:
- "We", "us", "our" refers to Condor Trails, operated by Aleksander Canchaya, Dublin, Ireland.
- "You", "your" refers to the lead passenger or person making the booking.
- "Booking" means any travel arrangement confirmed and paid for through Condor Trails.
- "Package" means a combination of at least two different types of travel services (e.g. transport, accommodation, car rental, or other tourist services) as defined under the EU Package Travel Directive 2015/2302.
- "Departure date" means the date on which your trip is scheduled to commence.
2. Booking & Payment
2.1 Making a Booking
A booking is confirmed once we have received your deposit payment and sent you a written confirmation via email. The person making the booking must be at least 18 years of age and accepts these Terms & Conditions on behalf of all members of the travelling party.
2.2 Deposit
A non-refundable deposit of 25% of the total trip cost is required at the time of booking to secure your reservation. For certain elements requiring advance booking (such as Inca Trail permits, Galápagos cruises, or peak-season accommodation), higher deposits may apply. We will advise you of this before confirmation.
2.3 Balance Payment
The remaining balance is due no later than 60 days before your departure date. If booking within 60 days of departure, the full amount is payable immediately upon confirmation.
2.4 Payment Methods
We accept bank transfer, credit card, and debit card payments. Payments may be made in USD, EUR, or GBP. Any currency conversion costs or bank transfer fees are the responsibility of the traveller.
2.5 Late Payment
If we do not receive the balance payment by the due date, we reserve the right to treat the booking as cancelled and retain the deposit paid.
3. Pricing
All prices quoted are per person unless otherwise stated and are based on costs at the time of quotation. We reserve the right to adjust pricing before a booking is confirmed. Once your booking is confirmed and deposit paid, the price is fixed except in cases of:
- Changes in transportation costs (including fuel surcharges)
- Government-imposed taxes, fees, or charges
- Currency exchange rate fluctuations exceeding 2%
In accordance with the EU Package Travel Directive, we will absorb the first 2% of any such increase. If the total price increase exceeds 8%, you have the right to cancel your booking and receive a full refund of all payments made.
4. Cancellation Policy
4.1 Cancellation by You
If you need to cancel your booking, you must notify us in writing via email to info@condortrails.com. The following cancellation charges apply, calculated from the date we receive your written cancellation notice:
| Notice Period | Cancellation Charge |
|---|---|
| More than 60 days before departure | Full refund minus €100 administration fee per person |
| 30–60 days before departure | 50% of total trip cost |
| Less than 30 days before departure | 100% of total trip cost (non-refundable) |
Some elements of your trip may carry non-refundable supplier charges (such as Inca Trail permits, internal flights, or cruise reservations) regardless of the cancellation timeline. We will inform you of any such non-refundable components at the time of booking.
4.2 Cancellation by Us
We reserve the right to cancel a booking in the event of insufficient participants, safety concerns, or circumstances beyond our control. If we cancel your trip, you will be offered either:
- An alternative trip of comparable standard, or
- A full refund of all payments made
We will not be liable for any additional costs incurred by you as a result of cancellation, including but not limited to flights, visas, or travel insurance.
5. Travel Insurance
Travel insurance is mandatory for all Condor Trails travellers. You must have comprehensive travel insurance that covers, at a minimum:
- Trip cancellation and curtailment
- Medical expenses and emergency evacuation (including high-altitude rescue where applicable)
- Personal liability
- Loss of luggage and personal belongings
- Repatriation
We strongly recommend a policy that includes cover for adventure activities if your itinerary includes trekking, rafting, mountain biking, or similar. You must provide us with your insurance policy number and emergency contact details before departure. We are not responsible for any costs arising from inadequate or absent insurance cover.
6. Itinerary Changes
While we make every effort to operate trips as described, the nature of adventure travel in Latin America means that itineraries may need to change. Condor Trails reserves the right to alter or modify any itinerary before or during the trip due to:
- Weather conditions or natural events
- Safety or security considerations
- Government regulations or restrictions
- Availability of accommodation, transport, or guides
- Road, trail, or infrastructure conditions
We will always endeavour to provide alternatives of comparable quality. If a significant change is made before departure, you will be notified as soon as practicable and given the option to accept the revised itinerary or cancel with a full refund.
7. Liability
7.1 Our Role
Condor Trails acts as an agent and intermediary between you and local travel service providers, including but not limited to hotels, airlines, ground transport operators, tour guides, and activity providers. These suppliers operate under their own terms and conditions.
7.2 Limitation of Liability
To the fullest extent permitted by law, Condor Trails shall not be liable for:
- Death, injury, illness, loss, damage, or expense arising from the act, negligence, or default of any third-party supplier
- Loss or damage to personal property
- Delays, cancellations, or changes caused by airlines, government actions, or events beyond our control
- Any loss arising from your failure to follow safety instructions or local laws
Nothing in these terms excludes or limits our liability for death or personal injury caused by our proven negligence, or any liability that cannot be excluded under Irish or EU law.
7.3 Compliance with the EU Package Travel Directive
Where your booking constitutes a "package" under the EU Package Travel Directive 2015/2302, we accept responsibility for the proper performance of all travel services included in the contract, regardless of whether these are provided by us or by other service providers. If any of the travel services are not performed in accordance with the contract, we will remedy the lack of conformity, unless this is impossible or entails disproportionate costs.
8. Health & Fitness
Many of our destinations involve high altitude, remote locations, and physically demanding activities. It is your responsibility to:
- Ensure you are physically fit and healthy enough for your chosen itinerary
- Disclose any medical conditions, allergies, dietary requirements, or mobility limitations before booking
- Obtain appropriate vaccinations and medical advice for your destination countries
- Carry necessary personal medications
We reserve the right to refuse participation in specific activities if we believe there is a risk to your safety or the safety of others.
9. Travel Documents
It is your responsibility to ensure that you hold a valid passport (with at least six months' validity beyond your return date) and any necessary visas, entry permits, or transit documents for all countries on your itinerary. Condor Trails cannot accept liability for any loss or expense resulting from your failure to secure the correct documentation.
10. Age Requirements
The lead person making a booking must be at least 18 years of age. Travellers under 18 must be accompanied by a parent or legal guardian at all times during the trip. For certain activities (such as adventure sports or specific trekking routes), minimum age requirements set by local operators may apply. We will advise you of these at the time of booking.
11. Force Majeure
We shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, earthquakes, volcanic eruptions, floods, or landslides
- Epidemics, pandemics, or public health emergencies
- War, terrorism, civil unrest, or political instability
- Government travel advisories, border closures, or airspace restrictions
- Strikes, labour disputes, or industrial action
- Severe weather events
In such cases, we will use our best efforts to offer alternative arrangements or rescheduling. Where this is not possible, we will issue a credit for future travel or, at our discretion, a refund minus any costs already incurred with third-party suppliers.
12. Complaints Procedure
If you have a complaint during your trip, please contact your local guide or Condor Trails' 24/7 support line immediately so we can attempt to resolve the matter on the ground.
If you remain dissatisfied, you must submit your complaint in writing within 28 days of your return date to:
Condor Trails
Email: info@condortrails.com
Phone: +353 85 760 4985

We will acknowledge your complaint within 5 working days and aim to provide a full response within 28 days. Complaints received after the 28-day window may be considered at our discretion but are not guaranteed a formal review.
13. Data Protection
We collect and process your personal data in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR) and Irish data protection legislation. By making a booking, you consent to the transfer of necessary personal data (including passport details and dietary or medical information) to our local partner operators for the purpose of fulfilling your booking.
14. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Ireland. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Irish courts.
For bookings that constitute a "package" under EU law, your rights under the EU Package Travel Directive 2015/2302 (as transposed into Irish law) are fully respected and upheld.
15. Amendments
We reserve the right to update or amend these Terms & Conditions at any time. The version in effect at the time of your booking will apply to your contract with us. Any material changes will be communicated to affected travellers before departure.
